§1 General provisions

  1. The data administrator is RS INVESTMENTS POLAND Sp. z o.o. with its registered office at 123C Wiśniowieckiego Street, 33-300 Nowy Sącz, entered in the Central Register and Information on Business Activity, NIP: 8992615334, REGON: 020563041. Data protection is performed in accordance with the requirements of generally applicable laws, and their storage takes place on secure servers.
  2. For the interpretation of terms, the Glossary of Terms and Conditions shall apply or as described in the Privacy Policy (where directly apparent from the description).
  3. For the purpose of a better perception of the Privacy Policy, the term “User” has been replaced by “You”, “Administrator” by “We”. The term “RODO” means the Regulation of the European Parliament and Council (EU) 2016/679 of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC.
  4. We respect the right to privacy and care about data security.
  5. Personal data provided in the form on the website shall be treated as confidential and shall not be visible to unauthorised persons.

§2 Data controller

  1. The service provider is the data controller of its customers. This means that if you are our customer or you have given optional consents visible when entering your data on our website, we process your data such as: name and surname, e-mail address, telephone number, job title, place of work, company name, physical address (postal code, city, street name) and identification data of your business/company/entity and IP address.
  2. The service provider is also the administrator of the newsletter subscribers.
  3. Personal data is processed:
    1. in compliance with data protection legislation,
    2. in accordance with the implemented Privacy Policy,
    3. to the extent and for the purpose necessary for the establishment, formation of the content of the Agreement, modification or termination thereof and the proper performance of the Services provided by electronic means,
    4. to the extent and purpose necessary for the fulfilment of legitimate interests (legitimate purposes) and the processing does not infringe the rights and freedoms of the data subject:
    5. to the extent and for the purpose in accordance with the consent given by you if you have subscribed to the newsletter.
  4. Every data subject (if we are the data controller) has the right of access, rectification, erasure or restriction of processing, the right to object, the right to lodge a complaint with a supervisory authority.

  6. We reserve the right to process your data after the termination of the Agreement or the withdrawal of consent only to the extent for the purpose of asserting possible claims in court or if national or EU or international law obliges us to retain the data.
  7. The Service Provider shall have the right to make the User’s personal data and other data of the User available to entities authorised under the relevant legislation (e.g. law enforcement agencies).
  8. The deletion of personal data may take place as a result of the withdrawal of consent or the lodging of a legally permissible objection to the processing of personal data.
  9. The Service Provider shall not make personal data available to entities other than those authorised by the relevant legislation.
  10. We have implemented pseudonymisation, data encryption and have access control in place to minimise the impact of any data security breach.
  11. Personal data shall only be processed by persons authorised by us or by processors with whom we work closely.

§3 Cookies

  1. The website www.blackmountain.pl uses cookies. These are small text files sent by a web server and stored by the browser’s computer software. When the browser reconnects to the site, the site recognises the type of device from which the user is connecting. The parameters allow the information contained in them to be read only by the server which created them. Cookies therefore facilitate the use of previously visited websites.
  2. The information collected relates to the IP address, type of browser used, language, type of operating system, internet service provider, information about time and date, location and information sent to the website via the contact form.
  3. The data collected is used to monitor see how users are using our sites to improve the site by providing a more efficient and seamless navigation experience. We monitor information about users using Google Analytics and Microsoft Clarity tools, which record user behaviour on the site.
  4. Cookies identify the user, allowing us to tailor the content of the site they use to their needs. By remembering your preferences, it makes it possible to tailor targeted advertising to you. We use cookies to ensure the highest standard of comfort on our website, and the data collected is used only within our company for the purpose of optimising our operations.
